Welcome to Midnight’s Wink. These Terms of Service (the “Terms”) govern your access to and use of the Midnight’s Wink website at midnightswink.com and any products purchased through it. Please read them carefully. By using the website or placing an order, you agree to be bound by these Terms.

1. About Midnight’s Wink

Midnight’s Wink is a Canadian company based in Alberta. We sell the Humidity Survival Kit™, a professional lash adhesive system consisting of Ocean™ adhesive, Desert™ adhesive, and The Lazy Lash-Glue Guide™. Orders are fulfilled from our warehouse partner in Springfield, Missouri, and shipped within the United States.

In these Terms, “we,” “us,” and “our” refer to Midnight’s Wink. “You” and “your” refer to the person accessing the website or placing an order.

2. Acceptance of These Terms

By accessing the website, creating an account, or placing an order, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy. If you do not agree, please do not use the website or place an order.

We may update these Terms from time to time. When we do, we will post the updated Terms on this page and change the Effective date at the top. Continued use of the website after an update means you accept the revised Terms.

3. Eligibility

To use this website and place an order, you must:

• Be at least 18 years old, or the age of legal majority in your jurisdiction, whichever is older.
• Have the legal capacity to enter into a binding contract.
• Provide a valid shipping address within the United States.

We do not knowingly accept orders from minors. If we discover that a minor has placed an order, we will cancel the order and refund the payment.

4. Product Safety and Intended Use

The Humidity Survival Kit™ is a professional lash extension adhesive intended for use by trained lash technicians. Ocean™ and Desert™ contain cyanoacrylate, a bonding agent that requires training and appropriate workspace conditions to use safely.

Please read before using this product:

• This product is intended for professional lash extension application by trained lash technicians. It is not intended for use on oneself, for use by anyone without training, or for use by minors.
• Cyanoacrylate adhesives can cause serious eye injury if they come into contact with the eyes. They can also bond skin, eyelashes, and eyelids together on contact.
• Use in a well-ventilated workspace. Cyanoacrylate vapours may cause respiratory irritation, especially in enclosed rooms.
• Some individuals may develop an allergic reaction to cyanoacrylate. Discontinue use if you or your client experiences swelling, redness, itching, burning, or difficulty breathing, and seek medical attention.
• Keep out of reach of children and pets.
• Store away from direct sunlight, heat, and open flame.

You agree that you are responsible for your own training, your workspace conditions, your application technique, and your compliance with any professional licensing or regulatory requirements in your jurisdiction. If you are unsure whether this product is appropriate for you, please consult a trained lash technician or industry professional before purchasing.

Midnight’s Wink is not responsible for injury, damage, or loss resulting from misuse of the product, use by untrained individuals, or use outside the intended professional application.

5. Products, Pricing, and Availability

All prices on the website are listed in United States dollars (USD). Prices are subject to change without notice. The price displayed at the time you complete checkout is the price that applies to your order.

We reserve the right to limit quantities, refuse or cancel orders, and correct pricing or product errors at any time — including after an order has been placed. If we cancel an order for these reasons, we will refund any payment received.

Product availability may change. We do not guarantee that any specific product will remain in stock or continue to be offered.

6. Orders and Payment

When you place an order through the website, you are making an offer to purchase the products in your cart at the prices and terms displayed at checkout. Your order is not accepted until we send an order confirmation by email. We reserve the right to accept or decline any order at our discretion.

We accept payment through Stripe and PayPal. When you provide payment information, you confirm that the payment method is yours and that you are authorised to use it. Payment must be received in full before an order is shipped.

You are responsible for providing accurate billing and shipping information at checkout. We are not responsible for delays or non-delivery caused by incorrect address information you provide.

7. Shipping and Delivery

We currently ship only to addresses within the United States and United States territories. We do not ship internationally at this time.

Orders are fulfilled from our warehouse partner in Springfield, Missouri. Shipping times depend on the carrier, the destination, and factors outside our control (weather, carrier delays, holidays). Estimated delivery windows displayed at checkout are approximations, not guarantees.

Risk of loss and title for products pass to you when the products are delivered to the shipping carrier. If your order is lost, damaged, or does not arrive, please contact us and we will work with you to resolve the situation under our Satisfaction Guarantee (Section 9).

8. Sales Tax

We collect sales tax where required by law. Because our fulfillment warehouse is located in Missouri, we collect Missouri sales tax on orders shipped to Missouri addresses. We may also collect sales tax in other United States states where we are required to do so based on economic or physical nexus rules. Applicable sales tax will be shown at checkout before you complete your order.

9. Satisfaction Guarantee

We want you to be satisfied with your Humidity Survival Kit™.

Within 60 days of receiving your order.

If you are not satisfied with your kit for any reason, please contact us within 60 days of receiving your order. We will either refund your purchase or ship a replacement, based on the situation and your preference. We handle each case individually and will do our best to make things right.

After 60 days.

We’re still happy to hear from you. Please reach out and we will do what we reasonably can — but formal refunds and replacements are limited to the 60-day window.

How to make a request.

Email us at with your order number and a brief description of the issue. We aim to respond within two business days.

Chargebacks.

If you have a concern about your order, we ask that you contact us first before filing a chargeback with your credit card company. We can almost always resolve issues faster than a chargeback dispute.

10. Customer Accounts

You may create an account on the website to place orders, view order history, and manage your information. When you create an account you agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your login credentials.
• Notify us promptly if you believe your account has been accessed without your permission.
• Accept responsibility for activity that occurs under your account.

You may close your account at any time by contacting us. We may suspend or close an account if we believe it is being used in violation of these Terms, applicable law, or in a way that is harmful to us or to other customers.

11. Acceptable Use

When using the website, you agree not to:

• Interfere with, disrupt, or attempt to gain unauthorised access to the website, our servers, or any related systems.
• Use the website to distribute malware, spam, or unlawful content.
• Scrape, copy, or otherwise extract website content for commercial use without our written permission.

We reserve the right to investigate and take appropriate action — including suspending access, cancelling orders, and reporting to law enforcement — against anyone who violates these terms.

The Midnight’s Wink name and logo are registered trademarks in the United States and Canada. Humidity Survival Kit™, Ocean™, Desert™, and The Lazy Lash-Glue Guide™ are trademarks of Midnight’s Wink.

All content on this website — including text, images, product photography, illustrations, the Lazy Lash-Glue Guide diagnostic content, and page layouts — is the property of Midnight’s Wink or licensed to us, and is protected by copyright and other intellectual property laws.

To the fullest extent permitted by law, Midnight’s Wink and its owners, employees, contractors, and business partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the website or the products — including lost profits, lost data, or reputational harm — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to these Terms, the website, or any product will not exceed the amount you paid for the product giving rise to the claim, or fifty United States dollars, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Midnight’s Wink, its owners, employees, contractors, and business partners from any claim, demand, loss, or damage — including reasonable legal fees — arising out of your use of the website, your violation of these Terms, your violation of any law, or your misuse of any product purchased through the website.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Alberta, Canada, and the federal laws of Canada that apply in Alberta, without regard to conflict of laws principles.

Any dispute arising out of or related to these Terms, the website, or any product will be brought exclusively in the courts of the Province of Alberta, and you consent to the personal jurisdiction of those courts. Before commencing any legal action, you agree to first contact us in good faith to attempt to resolve the dispute.

If we make material changes — for example, if we expand shipping outside the United States or add new product lines — we will make the update prominent on the website.
